By continuing to use ProPlay11, Users accept any amendments made to the Terms and Conditions. ProPlay11 may notify Users of such changes via email or account notifications, giving Users the option to reject the modified Terms and Conditions.
3. Certain ProPlay11 Services may have additional rules and regulations that prevail if inconsistent with these Terms and Conditions.
4. ProPlay11 holds the discretion to:

1. Restrict, suspend, or terminate a User's access to ProPlay11 or ProPlay11 Platform Services.
2. Suspend or discontinue all or part of the ProPlay11 Platform Services.
3. Reject, move, or remove User-submitted material.
4. Move or remove content available on ProPlay11 Platform.
5. Implement general practices and limits on ProPlay11 Platform usage.
6. Offer discounts in the form of a "Cash Bonus" credited to a separate Cash Bonus Account.
7. Revise the player roster for Contests due to changes in the relevant Sports Event.
8. Assign rights and liabilities of User accounts to any entity (with intimation to Users).

5. If a User breaches these Terms and Conditions or misuses ProPlay11 Services, ProPlay11 may restrict, suspend, or terminate the User's access without notice, deactivate or delete the account and related information, remove User-posted content, and take appropriate technical and legal measures.
6. ProPlay11 will repay platform fees if an account or ProPlay11 Services are suspended or removed due to negligence or deficiency on its part, but not for suspension or removal due to user breaches or circumstances beyond ProPlay11's control.
7. Users consent to receive communications, announcements, and advertisements from ProPlay11 or its partners, licensors, or associates.
8. Users must not engage in activities compromising the platform's security, including unauthorized access, probing, scanning, testing vulnerability, interfering with service, or sending unsolicited electronic mail.
9. Violations of system or network security may lead to civil or criminal liability.
10. Users must adhere to strict guidelines while using the platform and should not transmit, distribute, store, or attempt to destroy material that may encourage criminal offenses, infringe intellectual property rights, or contain offensive content.

Intellectual Property

• ProPlay11 incorporates a mix of content, including games, Contests, software, graphics, images, and more, created by ProPlay11, its partners, affiliates, licensors, associates, and Users. The Intellectual Property Rights in all software and material published on ProPlay11 are owned by ProPlay11, its partners, licensors, and/or associates. Without express written license from ProPlay11, Users are prohibited from exploiting, modifying, distributing, or creating derivative works of any materials or content on ProPlay11.
• Users can request permission to use any ProPlay11 content by contacting ProPlay11 Helpdesk.
• Users are solely responsible for the materials they upload, post, or transmit on ProPlay11 "Users' Content". Each User must own all Intellectual Property Rights in their content and ensure it does not infringe any third-party rights. Users also agree not to display or use any third-party names, logos, trademarks, or copyrights on ProPlay11 without proper authorization. Users indemnify and hold ProPlay11 harmless against any claims or damages arising from such unauthorized use.
• By posting content on ProPlay11, Users grant a worldwide, irrevocable, royalty-free license to ProPlay11 and its affiliates for displaying, distributing, and storing Users' Content on the platform for various purposes, including public display and distribution to other Users.
• All names, logos, marks, trademarks, or intellectual property rights on ProPlay11 belonging to any entity are recognized as proprietary to their respective owners. Any issues concerning these rights should be addressed directly to the respective parties under notice to ProPlay11.
• Unauthorized use, reproduction, distribution, or modification of the content on ProPlay11 is strictly prohibited without obtaining written permission from the respective organization or entity.

Third-Party Sites, Services, and Products

1. ProPlay11 may include links to third-party Internet sites operated by other entities. Users' use of these sites is subject to the respective site's conditions, if any. ProPlay11 does not exercise control over these third-party sites and cannot be held responsible for the content they contain. Inclusion of third-party content or links on ProPlay11 does not constitute an endorsement by ProPlay11.
2. Any correspondence, transactions, or offers with third parties, including payment providers and verification service providers, are solely between the User and the third party. Users are responsible for reviewing the terms and conditions of such third parties before transacting with them. ProPlay11 shall not be liable for any loss or damage resulting from such transactions or offers.
3. ProPlay11 contains content created by ProPlay11 and third-party content. While ProPlay11 ensures the accuracy and integrity of its own content, it does not guarantee the same for third-party content. Safe-Play Policy and Guidelines:

1. ProPlay11 aims to provide timely services, notifications, Fun Features, and Contest(s), but external factors may cause delays beyond our control.
2. Live match data from a third party is used for Safe-Play, but it may be subject to modifications or updates.
3. Discrepancies in playing 11 updates for Safe-Play matches due to data provider loopholes will not result in contest entry refunds. Users should cross-check on official platforms.
4. Residents of Andhra Pradesh cannot join paid contests due to recent changes in the Gaming Act. Residents of Assam, Odisha, Telangana, Nagaland, and Sikkim may have restrictions on pay-to-play formats.

Conditions for Participation

Such conduct includes, but is not limited to:

Users are strictly prohibited from engaging in any of the following activities, which are deemed as improper and in violation of ProPlay11's Terms of Use:

1. Providing false or fake personal information, including name, email address, bank account details, or any other requested documentation, to enter a contest or claim a prize.
2. Engaging in financial fraud or misrepresentation, including unauthorized use of credit/debit cards or payment wallet accounts, to enter a contest or claim a prize. The burden of proof lies solely on the user to demonstrate otherwise.
3. Colluding with other users or participating in any form of syndicate play to gain an unfair advantage in a contest.
4. Violating any of the Contest rules or the Terms of Use.
5. Accumulating points or prizes through unauthorized methods, such as using automated bots or other means.
6. Using automated tools (e.g., bots, robots, parsers, spiders, or screen scrapers) to access user data or any information on the Website.
7. Misusing Cash Bonuses or the Invite Friends program or any other promotional offers.
8. Tampering with the administration of a contest or attempting to interfere with the computer programs or security measures associated with a contest.
9. Obtaining other users' information without their explicit consent or spamming other users with unsolicited emails or bulk communications.
10. Abusing the Website in any manner, including the use of offensive language, slangs, or disrespectful words.
11. Any user found to be engaging in any of these activities will be subject to disqualification from contests and may face further legal action or account suspension at ProPlay11's sole discretion.

It is hereby clarified that should a User be found in violation of this policy, ProPlay11 reserves the right to pursue appropriate civil and criminal remedies, as advised, in addition to forfeiture and/or recovery of any prize money, if applicable.

 

Registration for a Contest

1. Users accepting ProPlay11's Terms and Conditions agree to provide accurate and updated information during registration and whenever requested by ProPlay11. They must keep their registration details current. Information required for registration include –

4. Password
5. State of Residence
6. Gender
7. Date of birth

2. Each user is allowed to register and use only one user account with ProPlay11.
3. The password issued by ProPlay11 to individual users must be kept confidential and not shared with anyone else.
4. Users are solely responsible for maintaining the confidentiality of their accounts and passwords. They consent to promptly report any unauthorized account use or security breaches.
5. Users must log out of their accounts at the end of each session to avoid potential loss or damage for which ProPlay11 shall not be held responsible.
6. Users are responsible for the security and confidentiality of their linked payment accounts. Any misuse of linked payment accounts should be reported to ProPlay11 immediately.
7. ProPlay11 reserves the right to suspend the account of any user using an offensive Team name.
8. Users must adhere to appropriate conduct on ProPlay11, refraining from engaging in inappropriate activities, such as:

1. Engaging in offensive, indecent, racial, or abusive actions or communication.
2. Harassing, threatening, or violating the legal rights of others.
3. Transmitting files that may damage or affect another person's computer or ProPlay11.com.
4. Advertising or selling goods or services without ProPlay11's consent.
5. Transmitting spam, unsolicited advertising, or chain letters.

9. Users must not engage in any form of attack on ProPlay11's services, including the distribution of viruses or attempts to disrupt its operations.
10. Users agree to abide by the Terms and Conditions and other rules set by ProPlay11. Failure to comply may result in remedial actions such as restricting, suspending, or terminating user access to ProPlay11 Services, deactivating or deleting user accounts, or refraining from awarding prizes to the user.
11. Users confirm the accuracy of their registration information and agree to update it as required by ProPlay11.
12. Users acknowledge that their provided address details will be treated as the "Address on record" for Goods and Service Tax Act purposes and agree to update their profile promptly if there is any change.
13. Users are required to operate only one user account with ProPlay11.
14. Users must ensure they can receive all communications from ProPlay11 by marking emails or SMSs from ProPlay11 as part of their "safe senders" list.
15. Users are responsible for promptly notifying ProPlay11 of any unauthorized account use or security breach.
16. Users must log out of their accounts at the end of each session to prevent loss or damage.
17. Users must not use cheats, automation, software, bots, hacks, or any unauthorized third-party software that may modify or interfere with ProPlay11 Services.
18. Users must not copy, modify, rent, sell, or transfer any technology or software underlying ProPlay11 without express written consent.
19. Users shall not modify any files or software that are part of ProPlay11's Services without ProPlay11's express written consent.
20. Users must not disrupt or overburden ProPlay11's servers or interfere with other users' enjoyment of ProPlay11 Services.
21. Users shall not attempt unauthorized access to ProPlay11 Services or tamper with its security, technology, or software.
22. Users must not publish false, misleading, or harassing content on ProPlay11.
23. Users must not engage in activities that threaten the unity, integrity, or sovereignty of India or violate any law.
24. ProPlay11 reserves the right to restrict or change usernames considered obscene, abusive, or associated with official teams, leagues, or sporting personalities.
25. Unauthorized access to ProPlay11 or using automated means is a breach of these Terms and Conditions and a violation of the law.
26. Use of ProPlay11 is subject to existing laws and legal processes, and ProPlay11 will comply with governmental and law enforcement requests.
27. Users can reach out to ProPlay11's Helpdesk within 48 hours of winner declaration for any concerns regarding a match or contest.
28. Users below the age of eighteen (18) are not allowed to participate in contests on the ProPlay11 Platform.
29. ProPlay11 is not responsible for any content contributed by users on the platform.
30. Users confirm their participation in contests for personal use and not in the course of business or profession.
31. Residents of Andhra Pradesh, Assam, Nagaland, Odisha, Sikkim, or Telangana are not allowed to sign up for any paid version of the Contest.

 

Contest(s), Participation, And Rewards

ProPlay11 offers a diverse range of contests in Fantasy Cricket. We warmly welcome participants to join contests in any of these sports on our platform. It is essential to note that the matches available on ProPlay11 are real ongoing matches played on the field, ensuring a genuine and immersive gaming experience. We act as an intermediary platform connecting participants with the official sources.

Participants have the flexibility to edit their teams until the official match start time is declared by the Sport Event officials or any adjusted deadline, as specified below. This ensures that participants can strategize and make informed decisions until the last moment, contributing to an engaging and dynamic gameplay environment.

ProPlay11 retains the authority to make adjustments to the deadline, up to a maximum of 10 minutes or 3 overs bowled, whichever is less, prior to the official match start time. In instances where ProPlay11 is unable to verify the official match time through reliable and publicly available sources, we reserve the right to set the deadline to a time before which a maximum of 3 overs have been bowled in the given match. This measure ensures fairness and accuracy in determining the deadline, guaranteeing an equitable and exciting gameplay experience for all participants.

MATCH START TIME EXCEEDS OFFICIAL DEADLINE: ProPlay11's Rights and Disclaimers:

1. Deadline Extension or Contest Abandonment: ProPlay11 reserves the right to extend the deadline or abandon a contest/game under various circumstances, including delayed toss, weather-related interruptions, non-appearance of teams, and technical/equipment glitches causing delays.
2. Starting Lineup Feature: The purpose of indicating a player's inclusion in the final starting lineup is to provide information and assist users in team selection. However, users are advised to conduct thorough research from official and other available sources of information, as ProPlay11's indication is based on data received from feed providers and publicly available sources. ProPlay11 does not bear liability if a player initially indicated as 'Playing' does not actually start for any reason.
3. Substitutes and Concussion Substitutes: Substitutes on the field will not be awarded points for their contributions. However, 'Concussion Substitutes' will receive four (4) points for their appearance in a match and will be awarded points according to the Fantasy Points System (effective from Nov 25, 2019) based on their contributions.

ProPlay11 offers a variety of contests on its platform as part of its services. Currently, the following contests are available: Fantasy Cricket. Participants are invited to create their fantasy teams consisting of real-life cricketers involved in the respective sports events, series, or tournaments - "Sport Events". ProPlay11 facilitates participants' fantasy game contests based on each Sport Event, allowing them to compete with their teams.

Participants have the flexibility to edit their teams until the official match start time is declared by the Sport Event officials or any adjusted deadline, as specified below. ProPlay11 reserves the right to abandon or adjust the deadline of a specific round in specific, uncertain scenarios beyond its reasonable control, including but not limited to the following:

• If the actual match start time is before the official deadline: ProPlay11 may adjust the deadline by a maximum of 10 minutes or 3 overs bowled, whichever is less, before the official match start time. If the official match time cannot be verified by ProPlay11 through reliable and publicly available sources, the deadline may be adjusted to a time before which a maximum of 3 overs in the given match are bowled.
• If the actual match start time is after the official deadline: ProPlay11 reserves the right to extend the deadline or abandon the contest/game based on circumstances like delayed toss, weather interruptions, team non-appearance, technical/equipment glitches causing delays, etc.

ProPlay11 strives to keep users informed about any changes in contest deadlines through email and/or SMS communication. Teams earn points based on real-life cricketers' performances at the end of designated matches, tournaments, or contests. The participants whose teams achieve the highest aggregate scores in the contests are declared "Winners". In certain pre-specified contests, there may be multiple winners, and prizes are distributed based on their team's aggregate scores at the end of the designated matches.

The Contest(s) on the ProPlay11 platform are governed not only by the Terms and Conditions mentioned herein but also by the "Fantasy Rules" available at “How To Play” and other rules and regulations, including payment guidelines. All participants are expected to abide by these rules and regulations.

Paid versions of the Contest(s) are available on the ProPlay11 platform. Users can participate in these contests by paying the pre-designated amount mentioned on the relevant Contest page. The "pre-designated amount" includes a platform fee for accessing ProPlay11 services and the participant's contribution towards the prize money pool. The participant with the highest aggregate points at the end of the pre-determined match becomes eligible to win a pre-designated prize disbursed from the prize money pool, as stated on the relevant Contest(s) page.

Participants are allowed to create different teams for participation in contests related to different Sport Events across the ProPlay11 Services. However, in contests where Multiple Entry is not allowed, participants can enter only one team. In Multiple Entry Contest(s), a participant may enter more than one team. ProPlay11 reserves the right to limit the maximum number of teams that a single user account can create or enter in a specific Multiple Entry Contest at its discretion.

Participants must pay a pre-designated amount to participate in the contests created on the ProPlay11 platform. Users indicating their residence in Andhra Pradesh, Assam, Nagaland, Odisha, Sikkim, or Telangana will not be allowed to sign up for any match or contest and may not participate in any paid version of the Contest(s).

In public contests where all participants have identical teams, including the captain and vice-captain, the contest prize money is equally divided among all participants. The amount is deposited in the ProPlay11 winning account of all participants, and the remaining amount is credited to their Cash Bonus account. Any violation of this policy may lead to appropriate action by ProPlay11, including forfeiture of the Cash Bonus Amount.

The Starting Lineup Feature provides information on a player's inclusion to assist users in selecting their team on ProPlay11. Users are advised to conduct thorough research from official sources and other reliable information as ProPlay11 shall not be liable if a player indicated as 'Playing' does not start for any reason.

Substitutes on the field do not earn points, except for specific categories like 'Concussion or COVID-19 or X Factor or Impact Player Substitutes,' who receive four (4) points for making an appearance in a match, in addition to points based on their contributions following the Fantasy Points System (w.e.f Oct 9, 2022). ProPlay11 aims to ensure fairness and accuracy in awarding points to participants.

 

Types of Contests

ProPlay11 offers two distinct contest formats to cater to user preferences: Public Contests and Private Contests. In Public Contests, users can join without restrictions, participating alongside other users. Private Contests, on the other hand, allow users to create personalized contests and invite specific participants. To ensure fairness and prevent abuse, there are participation limits: a maximum of 2,000 contests for cricket matches. Participating beyond the limit is automatically prohibited. All contest rules mentioned herein apply to both formats.

PRIVATE CONTESTS

1. In the Private contest format, ProPlay11 allows users to create personalized contests and invite others to participate. These contests can consist of 2 - 100 participants, providing a more exclusive gaming experience.
2. To create a Private contest, the user initiates it by paying the predetermined amount and receives a unique identification code ("contest Code") for their contest. Once the required number of participants is reached, the Private contest becomes operational, and no further participants can join.
3. Invited users can participate in the Private contest by entering the specific contest Code and paying the entry fee. However, their participation is subject to the pre-specified number of participants required for that particular contest. ProPlay11 is not liable for any inability of invited users to join due to hardware or technical issues or their own eligibility status.
4. Please note that once a Private contest is created, no changes in its terms or structure are allowed, except for modifying the contest's name. Additionally, in case a Private contest fails to reach the required number of participants one hour before the match, an automatic refund will be initiated for the deposited amount.

PUBLIC CONTESTS

1. In the Public contest format, ProPlay11 offers Contests with a range of 2 - 100 or any other predetermined number of participants. Participants may join these contests by paying an entry fee, and the winner will be determined based on the contest rules at the end of the match.
2. To activate a Contest, a specified number of participants must join. Once the required number is met, the Contest becomes operational. However, if the minimum participant count is not reached at the start of the match, the Contest will not proceed, and the entry fees will be promptly refunded to all participants.
3. In some Contests known as "Guaranteed contests," the Contest becomes operational when at least two users join, regardless of the total available slots filled. Participants can continue to join these contests until all slots are filled or the match begins, whichever comes first. If there's a shortfall in participants for the Guaranteed Contest, ProPlay11 will cover the deficit in the prize pool to ensure a fair and enjoyable experience for all.

 

Legality of Game of Skill

1. Games of skill are legal and fall outside the scope of Indian gambling legislation, including the Public Gambling Act of 1867. The Indian Supreme Court, in cases like State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153), has ruled that games predominantly dependent on a player's knowledge, training, attention, experience, and adroitness are classified as games of skill.
2. The Contests offered across the ProPlay11 services are games of skill since the success of Participants is primarily based on their superior knowledge of cricket statistics. Participants need to demonstrate their understanding of players' form, and performance in specific conditions and formats (e.g., ODIs, test cricket, and Twenty20 in cricket fantasy), as well as strategic decision-making and team management to maximize their points.
3. By participating in these Contests, each Participant acknowledges and agrees that they are engaging in a game of skill.

 

Eligibility Criteria

1. Participants must be above the age of 18 years.
2. Participants must be currently residing in India.
3. Participants must have a valid email address for registration.
4. ProPlay11 reserves the right to bar individuals with insider knowledge of participating teams, organizing boards, or leagues from participating and withdrawing winning amounts.
5. Only registered participants who have completed their KYC in accordance with the procedure outlined above are eligible to participate and win prizes.
6. Referral Bonuses are available to users who have deposited a minimum of Rs. 100 before referring others.
7. ProPlay11 may restrict individuals residing in certain Indian states from participating in paid contests due to prevailing laws. Residents of Andhra Pradesh, Assam, Nagaland, Odisha, Sikkim, or Telangana are not allowed to participate in pay-to-play formats of online games, including ProPlay11, as per Indian law. Users from these states should refrain from registering on our platform, and any breach will result in the account being blocked, the balance reset to zero, and amounts debited without prior warning.

 

Payment Terms

1. Users authorize ProPlay11 to appoint a third-party Escrow Agent to manage funds related to their participation in Contests.
2. The payment made by Users to participate in Contests includes the platform fee and the prize pool contribution.
3. All amounts collected from Users are held in separate non-interest earning bank accounts, and payouts are made to Users, ProPlay11, and the Government (towards TDS on Net Winnings) from these accounts.
4. ProPlay11 may charge a Platform Fee, inclusive of applicable GST, which will be debited from the User's account balance.
5. Users participating in Contests with a prize pool contribute a pre-specified amount, which will be debited from their account balance.
6. Users have 'Unutilized' and 'Winnings' accounts for payment processing.
7. Winnings reflect as credits in the 'Winnings' account, while deposits are credited to the 'Unutilized' account.
8. When participating in a Contest, the pre-designated amount is debited first from the 'Unutilized' account and then from the 'Winnings' account, if necessary.
9. Any remaining amount for participation is handled through the designated payment gateway.
10. Withdrawals from the Winnings Account are processed to the User's registered bank account within a reasonable period without any processing fee.
11. ProPlay11 may issue Cash Bonus for promotional activities, subject to usage limitations and restrictions.
12. Cash Bonus is non-transferable and may be used to offset Contest contributions.
13. The validity of Cash Bonus is 14 days from the date of credit.
14. Once a transaction is confirmed, it is final and non-cancellable.
15. ProPlay11 may consider refunds in exceptional circumstances, deducting applicable charges and taxes.
16. Transactions may take up to 24 hours for processing, and Users agree not to raise complaints regarding delays.

Additional terms and conditions, if any, will prevail in case of conflicts with the present terms and conditions.

 

Government Tax (GST) Compliance – Updated Deposit Process and Bonus Structure in accordance with the updated GST Regulations

In accordance with the recent implementation of the Goods and Services Tax (GST) at a rate of 28%, ProPlay11 has revised its deposit system. Please note the following changes:

1. Deposit Calculation:
   • When a user adds ₹100 to their ProPlay11 account, the actual deposit amount credited to their account will be ₹78.12.
   • The GST applied to this deposit amount is ₹21.88, which is 28% of ₹78.12.
2. Bonus Allocation:
   • In addition to the adjusted deposit amount, users will receive a bonus equivalent to 28% of their deposit amount.
   • For example, if a user deposits ₹100, they will receive a bonus of ₹21.88.

These adjustments ensure compliance with the new GST regulations while maintaining the user's enjoyment of the full deposit amount when participating in contests.

 

Scoring System: Calculating Fantasy Points in Fantasy Sports

ProPlay11 obtains score feeds and other information needed for computing fantasy points from the third-party service provider(s) and/or the official website of the match organizer. If, in rare cases, any errors arise in computing fantasy points, selecting winners, or due to inaccuracies or incompleteness in the feed provided by the third-party service provider and/or match organizer's official website, ProPlay11 will make best efforts to rectify the error before prize distribution. However, it is clarified that ProPlay11 relies on the accuracy and completeness of these third-party feeds and does not warrant or represent their accuracy. ProPlay11 shall not be responsible for inaccuracies in computing fantasy points or selecting winners resulting from inaccurate or incomplete scores/statistics from the third-party service provider. Users and Participants agree not to raise any claim or complaint against ProPlay11 regarding this matter.

 

Selection and Verification of Winners and Conditions Relating to the Prizes:

SELECTION OF WINNERS: Teams are awarded points based on the real-life performances of cricketers at the end of a designated match or tournament. The Participant whose Team achieves the highest aggregate score in the Contest(s) shall be declared the Winner(s). In certain pre-specified Contests, there may be more than one Winner, and prizes will be distributed to such Winners in increasing order of their Team's aggregate score at the end of the designated match(es) of the Contests.

CONTACTING WINNERS: Winners will be contacted via the email address provided during registration. The verification process and required documents for prize collection will be detailed to the Winners at this stage.

VERIFICATION PROCESS: Only Winners who successfully complete the verification process and provide the required documents within the specified time limit shall be permitted to withdraw/receive their accumulated winnings (or any part thereof).

TAXES PAYABLE: All prizes shall be subject to deduction of tax ("TDS") as per the Income Tax Act 1961. With effect from 1st April 2023, TDS of 30% shall be deducted on Net Winnings (NW) on each withdrawal request placed by the user. Net Winnings shall be calculated as follows: NW = A-B-C-D+E, where: A= Total withdrawal (including current withdrawal amount), B= Total Deposit, C= Opening Balance at the beginning of the financial year, D= Amount on which TDS was deducted, E= Closing balance of the user account at the end of the financial year. If a user does not withdraw any winnings during a financial year and has Net Winning balance as of 31st March, TDS of 30% shall be deducted on such Net Winnings balance. In case of any future revisions to the TDS rate or Net Winnings definition by the Government of India, TDS will be deducted according to the revised rate and definition. Winners are responsible for payment of any other applicable taxes in respect of the Net Winnings.

MISCELLANEOUS:

1. The decision of ProPlay11 regarding the awarding of prizes shall be final, binding, and non-contestable.
2. Participants playing the paid formats of the Contests confirm that they are not residents of Andhra Pradesh, Assam, Nagaland, Odisha, Sikkim, or Telangana. ProPlay11 will disqualify and forfeit any prize won by a Participant found to be a resident of any of these states.
3. If a Participant playing the paid formats of the Contests is under the age of eighteen (18), ProPlay11 may disqualify such Participant and forfeit their prize.
4. ProPlay11 may vary or modify the prizes offered to winners at its sole discretion.
5. ProPlay11 is not responsible for the transportation or packaging of prizes to the winners.
6. Winners shall bear the shipping, courier, or any other delivery cost for the prizes.
7. Winners shall bear all transaction charges levied for the delivery of cash prizes.
8. All prizes are non-transferable, non-refundable, and cannot be exchanged or redeemed for cash or kind.
9. ProPlay11 is authorized to charge a pre-defined contest entry amount for allowing users to join the Contest(s).
10. In contests like "INFINITY CONTEST," the pool prize might increase or decrease depending upon the number of spots filled in that particular contest.
11. If two or more teams clash in Head to Head & Winner Takes All Contest, the winning prizes will be divided among all clashed teams.
12. If, due to some technical issue, any confirmed contest spots exceed the defined limit, the prize pool & winner will be changed accordingly.

If a user joins any confirmed H2H or Winners Takes All contest and more contestants join than the predefined spots, the prize pool and winners will get increased before the completion of the match.

 

Publicity

By accepting a prize, the Winner grants ProPlay11 and its affiliates the right to use their name, likeness, voice, and comments for advertising and promotional purposes in any media worldwide, without the need for further permissions or consents, and without any additional compensation.

The Winners also agree to make themselves available for promotional activities as required by ProPlay11, without any charge. The specific dates for such promotional activities will be at the sole discretion of ProPlay11 and may include press events, internal meetings, ceremonies, and other functions.

 

General Conditions

In the event that ProPlay11 becomes aware of any requirement for governmental, statutory, or regulatory compliances or approvals to conduct any Contest(s), or if it becomes evident that the conduct of any such Contest(s) is prohibited, ProPlay11 reserves the right to withdraw or cancel such Contest(s) without prior notice to Participants or winners. Users acknowledge that they shall not make any claims or contest such cancellations or withdrawals in any manner.

Additionally, employees are ineligible to participate in any Public Contest(s).

 

Dispute and Dispute Resolution

1. Any disputes arising from ProPlay11 Services (including Contests) or these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Mumbai, India, and shall be governed by Indian laws.
2. In case of a legal dispute, the party raising the issue shall provide written notification to the other party. Both parties shall attempt to resolve the dispute through discussions within fifteen (15) days.
3. If the dispute remains unresolved, it shall be settled through arbitration in Mumbai, India, as per the provisions of the Arbitration and Conciliation Act, 1996.
4. The arbitration award will be final and binding, and each party shall bear its arbitration costs. The arbitrator may pass interim orders, enforceable in competent courts.
5. These Terms and Conditions do not prevent ProPlay11 from seeking equitable or injunctive relief before, during, or after arbitration proceedings to safeguard its interests. Pursuing such relief does not waive ProPlay11's right to pursue monetary damages through arbitration.

 

Release and Limitations of Liability

1. Users access ProPlay11 Services voluntarily and at their own risk. ProPlay11 is not liable for any loss or damage, including accidents, injuries, death, or property loss, during access to ProPlay11 Services or participation in Contests.
2. By entering contests and accessing ProPlay11 Services, Users release and indemnify ProPlay11, its directors, employees, partners, associates, and licensors from all liability, costs, losses, or expenses, whether direct or indirect.
3. ProPlay11 accepts no liability for errors or omissions related to prizes, whether by itself or third parties.
4. Users are solely responsible for consequences arising from illegal acts or non-conformity with Terms and Conditions. Users indemnify ProPlay11 and its officers, directors, employees, and agents for any loss or damage incurred due to such acts.
5. Users shall indemnify, defend, and hold ProPlay11 harmless from any third-party claims arising from their engagement with ProPlay11 or participation in any Contest. ProPlay11 shall not be liable for acts or omissions related to User's engagement or participation.
6. In consideration of accessing ProPlay11 Services, Users waive and release all claims against ProPlay11, its agents, directors, officers, business associates, sponsors, employees, or representatives for any injuries, accidents, or mishaps arising from the provision of ProPlay11 Services or related to Contests or prizes.

 

Disclaimers

1. ProPlay11 and its affiliates shall not be responsible for the deletion, failure to store, miss-delivery, or untimely delivery of any information or material.
2. ProPlay11 disclaims responsibility for any harm resulting from downloading or accessing information, server quality, game quality, product quality, service cancellations, or prize cancellations. ProPlay11 is not liable for inaccessibility due to maintenance, service provider failures, computer viruses, natural disasters, or other uncontrollable causes. ProPlay11 content is distributed on an "as is, as available" basis.
3. Any material accessed or downloaded through ProPlay11 is at the User's own risk, and they will be responsible for any damage or loss of data resulting from the download.
4. ProPlay11 does not provide any warranty regarding the ProPlay11(s). It does not guarantee that the ProPlay11(s) will meet Users' requirements, be uninterrupted, secure, error-free, or that the obtained results will be accurate or reliable.
5. In case of errors, ProPlay11 reserves the right to rectify them, including set-off or deduction from the User's account.
6. ProPlay11, its partners, licensors, or associates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our sites.
7. ProPlay11 Services, events, or Contests requiring specific permission or authority may be cancelled if such permission is not obtained.
8. In the event of suspension or closure of Services, events, or Contests, Users shall not be entitled to make any demands or claims.

 

Miscellaneous Terms and Conditions

1. ProPlay11 will notify Users of certain events as required by applicable legislation. Such notices will be effective upon posting on ProPlay11 or delivering to the User's provided email address. Users must maintain accurate email information for notification purposes.
2. ProPlay11 is not liable for delays or failures caused by events beyond its reasonable control, including acts of God, war, terrorism, network failures, or match cancellations. In such cases, related Contests may be canceled, and appropriate refunds will be processed.
3. ProPlay11's failure to enforce any right or provision in these Terms and Conditions does not waive such rights.
4. Any claim or cause of action related to ProPlay11 or these Terms must be filed within thirty (30) days of its occurrence.
5. These Terms and Conditions, along with incorporated terms and policies, constitute the entire agreement between Users and Sandhya Sports Media Private Limited, superseding any prior agreements.
6. If any part of these Terms and Conditions is determined to be invalid, the rest shall remain in force.
7. ProPlay11 reserves the right to moderate, restrict, or ban Users' use of the platform at its discretion and without notice.
8. ProPlay11 may permanently close or temporarily suspend any ProPlay11 Services, including Contests, at its sole discretion.
9. Promotions/offers on the platform cannot be combined with other promotions or Cash Bonus.

1. For any complaints or grievances related to User Content that violates these Terms (excluding Intellectual Property Rights infringement), your access to the Platform, or any obscene, defamatory, or impersonation content, please email us at [email protected].
2. In your complaint or grievance, provide:

1. Your name and contact details: name, address, contact number, and email.
2. Your relation to the subject matter (complainant or on behalf of the affected person).
3. Name and age of the affected person if representing them, along with a statement of authority to act on their behalf.
4. Clear identification of the User Content in question.
5. A statement that you believe in good faith that the User Content violates these Terms.
6. Confirmation that the information provided is accurate.

3. To report Intellectual Property Rights infringement on the Platform, submit a written notice with:

1. Identification of the copyrighted work allegedly infringed.
2. Identification of the allegedly infringing material on the Platform.
3. Your contact details: name, address, email, and phone number.
4. A statement that you believe the use of the copyrighted material is unauthorized.
5. A statement that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.
6. Your signature or that of your authorized agent.

ProPlay11 Invite Friends Program - Terms and Conditions

1. Eligibility: All registered users are eligible for pay-to-play games on ProPlay11.
2. Participation is voluntary, and one user should not have multiple accounts.
3. Program duration: 11th June 2023, 05:00:00 IST to 1st October 2023, 23:59:59 IST.
4. By participating, you agree to these Terms.
5. Inviter receives rewards when Invitee joins a paid public contest.
6. The inviter shares a unique link/code for Invitee registration.
7. Invitee must join a paid public contest before 1st October 2023 for Inviter to earn rewards.
8. The invitee must be at least 18 years old and not from Andhra Pradesh, Telangana, Sikkim, Odisha, Nagaland, or Assam.
9. Verification may be required during contest join or adding cash to the Unutilized Account.
10. Invitee gets a 75% discount up to Rs. 100, valid for 21 days on paid public contests (above 1000 members) before 1st October 2023.
11. Inviter can receive discounts, or Cash Bonus as rewards (with specific terms).
12. Inviter rewards are credited within 15 days after the Invitee joins a paid public contest.
13. Rewards are subject to compliance with these Terms.
14. ProPlay11 reserves the right to withhold or forfeit rewards and deactivate accounts for violations.
15. ProPlay11 may disqualify Inviter/Invitee for illegal or improper conduct.
16. ProPlay11's decision on the Program is final.
17. This Program cannot be combined with other promotions/programs.
18. The Terms and Conditions for ProPlay11's fantasy games and services apply to the Program.
19. ProPlay11 is not obligated to respond to participant feedback or queries.
20. ProPlay11's aggregate liability to a participant shall not exceed ₹100.
